A New York court recently struck down state Office of Mental Health regulations governing research involving subjects with impaired decisionmaking capacity. The court held that neither incapacitated adults nor minors could participate in any research protocol that contained a nontherapeutic element, irrespective of possible benefits to the subject or the importance of the knowledge to be gained. Although the decision rested on a technical point of law and dealt only with psychiatric research, the court's holding has significantly broader implications.

The volume documents, and makes an original contribution to, an astonishing period in twentieth-century philosophy—the progress of Arne Naess's ecophilosophy from its inception to the present. Regular musical activity as a complex multimodal lifestyle activity is proposed to be protective against age-related cognitive decline and Alzheimer’s disease. This cross-sectional study investigated the association and interplay between musical instrument playing during life, multi-domain cognitive abilities and brain morphology in older adults from the DZNE-Longitudinal Cognitive Impairment and Dementia Study study. Participants reporting having played a musical instrument across three life periods were compared to controls without a history of musical instrument playing, well-matched for reserve proxies of education, (...) intelligence, socioeconomic status and physical activity. Participants with musical activity outperformed controls in global cognition, working memory, executive functions, language, and visuospatial abilities, with no effects seen for learning and memory. The musically active group had greater gray matter volume in the somatosensory area, but did not differ from controls in higher-order frontal, temporal, or hippocampal volumes. However, the association between gray matter volume in distributed frontal-to-temporal regions and cognitive abilities was enhanced in participants with musical activity compared to controls. We show that playing a musical instrument during life relates to better late-life cognitive abilities and greater brain capacities in OA. Musical activity may serve as a multimodal enrichment strategy that could help preserve cognitive and brain health in late life. Longitudinal and interventional studies are needed to support this notion. (shrink)

Last year in June, British doctors went on strike for the first time since 1975. Amidst a global economic downturn and with many health systems struggling with reduced finances, around the world the issue of public health workers going on strike is a very real one. Almost all doctors will agree that we should always follow the law, but often the law is unclear or does not cover a particular case. Here we must appeal to ethical discussion. The General Medical (...) Council, in its key guidance document for practising doctors, Good Medical Practice, claims that ‘Good doctors make the care of their patients their first concern’. Is this true? And if so, how is this relevant to the issue of striking? One year on since the events, we carefully reflect and argue whether it was right for doctors to pursue strike action, and call for greater discussion of ethical issues such as the recent strikes, particularly among younger members of the profession. This was a class handout that I turned into a publication. As its title indicates, it's about the relation (or non-relation) of (ethical) cultural relativism to tolerance. Core elements of the paper were later absorbed into sections 5K, 6M, and 7K of my paper "Cultural Relativism" (2000), which is listed (and downloadable) on my PhilPapers page.

I have argued that like Harry Frankfurt, Augustine implicitly distinguishes between first-order desires and higher-order volitions; yet unlike Frankfurt, Augustineheld that the liberty to form different possible volitional identifications is essential to responsibility for our character. Like Frankfurt, Augustine recognizes that we can sometimes be responsible for the desires on which we act without being able to do or desire otherwise; but for Augustine, this is true only because such responsibility for inevitable desires and actions traces (at least in part) (...) to responsibility for our volitional identifications, which in turn has leeway-libertarianconditions. However, David Hunt has interpreted Augustine’s account of divine foreknowledge as implying a type of source-incompatibilism that does not require alternative possible actions or intentions. Moreover, while Eleonore Stump’s account of Augustine on sanctification supports my interpretation, Augustine’s position on predestination in his latest writings may be incompatible with liberty of the higher-order will. I will argue against Hunt’s interpretation but admit that the leeway-libertarian has to reject the ‘no autonomy’ model in some of Augustine’s late writings. (shrink)

This paper argues that the eschatological dimension of religion is distinct from other fundamental dimensions, including moral grounding, the ontological basis of reality, and the constitution of persons. It responds in particular to Tibor Horvath's conception of the category of ultimate reality. It also argues that eschatological hereafters imply something akin to an higher-time A-series, in that the hereafter can be conceived as a temporal order beyond currently existing time.

During the Bill Clinton and George W. Bush administrations, the Executive Office of the President became dominated by West Wing advisers who specialized in campaign politics, media management, and nonstop public communications. With record numbers of presidential appointees requiring no congressional approval, the Bush White House pursued partisan control of cabinet agencies. Even obscure federal bureaus were required to remain “on message.” The constitutional derangement about which The Rhetorical Presidency had warned has occurred. Cellular interactions in the mammalian ovarian follicle between its germ‐line and somatic cell components are crucial for its development and function. These interactions are mediated by both membrane gap junctions and paracrine factors. Somatic cell‐to‐oocyte communication is essential for oocyte growth and the regulation of meiotic maturation. In particular, granulosa cells provide nutrients and molecular signals that regulate oocyte development. Oocytes, on the other hand, promote the organization of the follicle, the proliferation of granulosa cells, and the differentiation and function (...) of cumulus cells, a subset of granulosa cells. Determining the nature of the oocyte‐to‐granulosa cell signals remains a key challenge for future work. (shrink)

Schizophrenia has attracted more than its fair share of evolutionary-based theories. The theories involving balancing selection are based on the assumption that the incidence of schizophrenia is invariant across time and place. Modern epidemiology allows us to reject this dogmatic belief. Once variations in the genetic and epidemiological landscape of schizophrenia are acknowledged, more productive research models can be generated. (Published Online November 9 2006).

During balanced growth of cells in culture all extensive properties of the culture — e.g. cell number, total mass, total DNA content — increase exponentially at the same specific growth rate. Therefore, in some average sense, each component of a cell must double between birth and division. For DNA there exists an elaborate mechanism to ensure precise replication of the genetic material and accurate partitioning of identical copies of the genome to the two daughter cells. Do cells possess another mechanism (...) that intentionally relates the timing of cell division to overall increase in cell size, or is the coordination of growth and division an incidental consequence of size‐independent rules for progress through the cell cycle?. Major events of the cell cycle—DNA synthesis, mitosis and cell division—are regulated by a complex network of protein interactions that control the activities of cyclin‐dependent kinases. The network can be modeled by a set of nonlinear differential equations and its behavior predicted by numerical simulation. Computer simulations are necessary for detailed quantitative comparisons between theory and experiment, but they give little insight into the qualitative dynamics of the control system and how molecular interactions determine the fundamental physiological properties of cell (...) replication. To that end, bifurcation diagrams are a useful analytical tool, providing new views of the dynamical organization of the cell cycle, the role of checkpoints in assuring the integrity of the genome, and the abnormal regulation of cell cycle events in mutants. Johnson and Stricker published an opinion piece in the Journal of Medical Ethics presenting their perspective on the 2008 agreement between the Infectious Diseases Society of America (IDSA) and the Connecticut Attorney General with regard to the 2006 IDSA treatment guideline for Lyme disease. Their writings indicate that these authors hold unconventional views of a relatively common tick-transmitted bacterial infection caused by the spirochete Borrelia burgdorferi. Therefore, it should come as no surprise that their opinions would clash with the IDSA's (...) evidence-based guidelines for the diagnosis and treatment of Lyme disease. Their allegations of conflict of interest against the IDSA resemble those made against the National Institutes of Health, the Food and Drug Administration and the Centers for Disease Control and Prevention in 2000, which were found to be baseless. It is the responsibility of all physicians and medical scientists to stand up to antiscientific, baseless and unethical attacks on those who support an evidence-based approach to caring for patients.
